                   Blagdon Farm Country Holidays Terms & Conditions

Please read these Terms & Conditions carefully. Your booking and deposit for a holiday constitute acceptance of them

1. BOOKING You enter into a contract, and become subject to these terms and conditions, with Blagdon Farm LLP when we receive your deposit and confirm your booking. When you make the booking, you warrant that you have the authority of all persons in your party to book on their behalf, and will indemnify Blagdon Farm Country Holidays against all loss and damage arising directly or indirectly, from any act or default by yourself or any person or animal accompanying you or part of your party booking. Bookings are not transferable. We reserve the right to correct an error in the brochure price until your account is paid in full.

2. DEPOSITS & PAYMENTS A deposit of 30% of the total holiday cost is payable on all bookings. A provisional booking (a booking for which no deposit has been received) is held for seven days and will only become a booking on receipt of the 30% deposit. The balance is payable no later than eight weeks from the commencement of the holiday and cancellation does not remove this liability. Reminders are not sent and if the balance is not received within eight weeks from the commencement of the holiday the booking will deemed to be in default, the cottage(s) will be made available and action may be taken to secure the outstanding monies.

3. LIMITATIONS OF LIABILITY The use of holiday accommodation, equipment and all/any facilities is entirely at the holidaymaker's own risk and no liability is accepted for any loss, damage, sickness or injury howsoever caused which may be sustained during the holiday to any member of the party, or any vehicle, its contents or any possessions of the holiday maker. All persons or their carers are responsible for carrying out their own Risk Assessment prior to using the facilities at Blagdon Farm, including the Swimming Pool, Grounds and Cottages.

4. CARE OF PROPERTY It is a condition of acceptance of any booking that the holidaymaker will take good care of the property, its contents and fittings and ensure that it is left in a truly clean and tidy state as it will have been found. The care is to include all furnishings, utensils, crockery and linen and though you might not be charged for minor breakages, you are responsible for all damage or breakages. Blagdon Farm retains the right to charge for any breakages or for any additional cleaning that may be required if the cottages are not left in a clean state.

5. ARRIVAL & DEPARTURE You may arrive on site anytime between 3:00pm - 10.00pm on your day of arrival but if after 6:00pm please inform us so we may make arrangements with you. Cottages must be vacated by 10.00am on the day of departure. If you have booked more than one cottage, we cannot guarantee that these will all be together.

6. SPECIAL EQUIPMENT To help those with limited mobility enjoy their holidays to the fullest, we do have special equipment such as wheelchairs, scooters, shower chairs, hoists etc which may be hired for the duration of your holiday. It is the responsibility of the guest or their carer, whoever is responsible for using this equipment, that they ensure the safety of other guests and the facilities. All equipment must be cleaned thoroughly before it is returned and in particular any piece of equipment that has been used in the bathroom. Blagdon Farm retains the right to charge for any cleaning that may be required if equipment is not left in a clean state. Guests that require assistance must be accompanied by a companion or helper who is capable of, has adequate training, and is totally responsible for, providing such assistance or the use of any such equipment. All guests and helpers use equipment supplied entirely at their own risk and Blagdon Farm will not be held responsible for any claim relating thereto. Any arrangements made by a guest for such assistance remains the sole responsibility of this guest, and Blagdon Farm will not be held responsible for any claim relating thereto.

7. COMFORT & SAFETY OF GUESTS Our guests visit Blagdon Farm to enjoy the peace and tranquillity. If anyone does not respect this, they may be asked to leave at any time. We reserve the right to decide whether to accept, reject, or retain any guest on the basis of general behaviour who is likely to, or does, infringe on the rights, welfare, or enjoyment of other guests. We also reserve the right to decide whether to accept, reject, or retain any guest who, because of any physical or mental health condition or disorder, poses a direct threat to the health or safety of either staff or other guests

8. SERVICES, FEATURES AND FACILITIES There may be certain facilities available which are not owned and/or operated by Blagdon Farm Country Holidays and you will need to make a separate booking with the operator direct. Such facilities are offered to enhance the enjoyment of your stay, but Blagdon Farm Country Holidays cannot be responsible for any injury, loss or damage that may result from your using such facilities. Information about features, facilities or services are to the best of our knowledge and belief, accurate at time of publication of the brochure, Information folder or website, but some of these features, facilities and services may not be available at the time you take your holiday. Each cottage has one vehicle space in order that one car/van may be parked within the parking boundaries of the cottage booked. Any additional vehicles must be parked in the car park adjacent to the cottages. Parking is entirely at the holidaymaker's own risk and no liability is accepted for any loss, damage or injury howsoever caused. Blagdon Farm is situated in a farming environment, and we cannot, and do not, accept responsibility for any damage or inconvenience caused by wildlife. This includes, but is not limited to, chickens, ducks, geese, goats, pigs, sheep and any deer and wildlife which may live in the nearby forest. Your booking includes a fee for the use of the pool, bar, fishing lake and other facilities provided at Blagdon Farm.

9. CIRCUMSTANCES BEYOND OUR CONTROL If for any reason beyond Blagdon Farm Country Holidays control, a cottage is not available or has been rendered unsuitable for holiday letting (e.g. fire damage) on the date booked, we will offer alternate accommodation and/or alternate dates or offer a refund of all monies paid by the holidaymaker. There shall be no further claim against Blagdon Farm Country Holidays.

10. LICENSED BAR We hold a full ON and OFF-licence. Licensing regulations state that that if children are brought to the bar, they must be accompanied by an adult and must be seated at a table. Children are not permitted at, or near to the bar.

11. CHILDREN Must be supervised at all times by an adult and must not be permitted to wander the site unaccompanied or unsupervised, this includes, but is not limited to the grounds themselves the playground, playground equipment, the animal area, lake, bar and pool.

12. BOOKING AMENDMENTS Amendment’s, if we are able to satisfy these, are subject to a £12 administration fee. Within 7 days of the will only be made in exceptional circumstances and in any case at the discretion of Blagdon Farm Country Holidays. Amendments are not accepted after your holiday has started.

13. NUMBER OF PERSONS & VISITORS The number of persons using the cottages is not to exceed the maximum number stated in the brochure, unless prior agreement has been reached. We reserve the right not to accept a booking or refuse entry if any of the booking conditions are not met. Permission for any additional guests, or day visitors, arriving during a holiday must be sought prior to their arrival, full details must be given and visitors are only accepted at our discretion.

14. BROCHURE INFORMATION & FACILITY FAILURE It is our aim to ensure that the information given in the brochure is accurate. However, Blagdon Farm Country Holidays cannot be held responsible for changes which may occur after the brochure is published. We cannot and do not accept liability for a breakdown of any facility at Blagdon Farm which is beyond our reasonable control (e.g. breakdown or failure of any electrical equipment, facility or plumbing) or from any misuse or negligence of the guest using Blagdon Farm Country Holidays equipment or facilities resulting in loss, injury or accident.

15. ACCESS The owners and/or their representative shall be allowed access to the property at any reasonable time during your holiday.

16. MINIMUM AGE We can only accept bookings for parties where there is at least one person aged 21 years or over in the party and we reserve the right to refuse all single sex parties.

17. CREDIT AND DEBIT CARD PAYMENTS Owing to the charges levied by card operators we do not accept credit cards.

18. SMOKING POLICY We are aware of the difference of opinion between smokers and non-smokers, particularly in close quarters such as cottages. As we have clients who have respiratory and breathing difficulties we do not permit smoking in the cottages, bar or pool.

19. ADDITIONAL TERMS & CONDITIONS In addition to the terms and conditions stated here, there may be specific terms and conditions which apply to the facilities on the site such as those concerning the use of the swimming pool. These will be prominently displayed on the site and/or in the cottage folders and constitute part of these general Terms & Conditions.

20. VAT Prices include VAT currently rated at 17.5%, where applicable. VAT rates are subject to Government legislation and prices may therefore change if VAT rates are altered.

21. COMPLAINTS It is our aim that everyone should have an enjoyable holiday. Nevertheless, should you have cause for complaint, please advise us immediately, as once a holidaymaker has returned home it is difficult for us to investigate complaints of any nature. Regrettably, therefore, we may not be able to accept and investigate complaints once a holiday has been completed.

22. CANCELLATIONS Cancellation’s must be formally notified in writing by booking signatory name and sent to Blagdon Farm Country Holidays, Ashwater, Beaworthy, Devon EX21 5DF. If a cancellation is for a holiday commencing more than eight weeks from the date of cancellation then the deposit will be forfeited and 70% of the total cost refunded. When a holiday is cancelled less than eight weeks from the commencement of the holiday the total holiday cost will be retained. Blagdon Farm will make every attempt to resell a cancelled holiday (possibly at discount) and, if successful, may refund up to 70% of any resold holiday price.

23. PRICES AND WEB SITE ACCURACY - CHANGES AND ERRORS Please note that holiday information and prices shown on our web site may have changed by the time you come to book your holiday. Whilst every effort is made to ensure the accuracy of the site and prices at all times, regrettably errors do occasionally occur. You must therefore ensure you check all details of your chosen holiday (including the price) with us at the time of booking. Any extra equipment costs will be advised to you at the time of booking.
